General Provisions
This agreement is concluded between ITC.ua (hereinafter referred to as the site administration) and a private individual who has visited the site pages or used at least one of the services provided within the site (hereinafter referred to as the site visitor).
The User Agreement regulates the use of the site’s resources, services, and features provided by the site administration as a platform for obtaining, posting information, and communication.
Site Visitor
1.1. A site visitor is any private individual who has visited and viewed at least one page of the site without prior registration and authorization on the site or forum.
1.2. A visitor who has registered and logged in using unique individual data becomes a site user.
1.3. The user has access to extended features provided within the site.
1.4. To use the site’s resources, services, and features, the user must first express their agreement with the Agreement. The user is not allowed to use the site if they have not accepted the terms of the Agreement.
1.5. A visitor is not allowed to use the site’s services and cannot accept the terms of the Agreement if the visitor has not reached the legal age required for entering into such agreements or has not met other conditions specified by the legislation for entering into similar agreements.
Use of Site Materials
2.1. Only registered site visitors – users are allowed to use interactive resources of the site, leave feedback, comment on materials, publish their own materials, and engage in online communication.
2.2. The user has the right to:
2.2.1. Post messages on the forum;
2.2.2. Comment on feedback, blog entries, video reviews;
2.2.3. Use the site’s resources in a manner that does not contradict the fundamentals of its activities.
2.3. Copyrights to the site’s materials, resources, and services, unless stated otherwise, belong to the site administration.
2.4. Copying site materials without the written consent of the administration is prohibited.
2.5. Partial quoting of site materials on an irregular basis is allowed with mandatory reference to the source page (no more than 5% of the total volume of the material).
2.6. All names, titles, trademarks, symbols, and slogans registered in the established order are the property of their lawful owners. Symbols (r) and/or ™ are not used in the site materials for their designation.
Commenting and Review Writing Rules
3.1. When writing reviews and comments, the user must adhere to the established rules and limitations.
3.2. Lack of knowledge of the rules, including restrictions on posting information and using site resources, does not exempt the visitor (including the user) from their compliance, and in case of violation, they are held responsible according to this Agreement and Ukrainian legislation.
3.3. The following are prohibited on the site:
3.3.1. Using the feedback form for purposes other than intended (e.g., for buying and selling announcements or questions to other users);
3.3.2. Offensive behavior towards other visitors and site administration representatives;
3.3.3. Posting profanity;
3.3.4. Posting messages with the purpose of provoking sharp reactions from other resource participants (trolling);
3.3.5. Unauthorized advertising, commercial messages, or announcements;
3.3.6. Posting materials containing offensive language or discrimination based on national, ethnic, racial, or religious affiliation;
3.3.7. Unauthorized posting of materials by the user, the copyright of which belongs to third parties;
3.3.8. Promotion of computer and audio-video piracy in any form, posting links to files and/or sites that directly violate or contribute to the violation of the copyrights of third parties (torrent trackers, file-sharing, warez sites);
3.3.9. Creating accounts with usernames that imitate official names (Administrator, Moderator, etc.) or are similar to the names of already registered users;
3.3.10. Using uppercase letters, punctuation marks, and special characters in message texts, except in cases regulated by language rules;
3.3.11. Posting calls for violent change or overthrow of the constitutional order, seizure of state power; changing the state border of Ukraine; riots, property destruction, building or structure seizure; aggression or initiation of a military conflict; other actions and posting of any messages prohibited by Ukrainian legislation;
3.3.12. Posting messages (feedback, comments) that fully, partially, or in terms of sense and content repeat previous messages (feedback, comments), including those deleted by the site administration based on this Agreement.
3.4. Posting messages devoid of informational content and unrelated to the resource’s topics is discouraged on the site.
Responsibility for Posting Materials
4.1. Within the site, users are provided with a platform for communication (feedback, blogs, forums, comment system, etc.). Any user can express their opinions regarding the site’s topics.
4.2. The responsibility for the accuracy of the information posted in publicly accessible sections of the site (feedback, forums, comments) lies solely with its author.
4.3. Publicly accessible sections of the site are subject to post-moderation – verification by a moderator (an authorized representative of the site administration) after the messages are posted.
4.4. A visitor who believes that the information on the site directly violates someone’s interests, and a user who has posted information, may contact the site administration to resolve disputes arising from the information posted on the site. Such visitors and/or users are obligated to try to resolve disputed issues through communication within the site, taking reasonable steps.
4.5. The site administration has the right to terminate the Agreement with the user at any time, including if the user violates any provision of the Agreement or takes actions that clearly indicate that the user does not intend or is unable to comply with the terms of the Agreement.
4.6. In case of a user’s violation of the conditions of this provision, the moderator may delete the posted information, feedback, or comment; block the user’s account; prohibit the user’s access to the site or restrict access to certain site features by IP address.
4.7. A clear objection to the actions of moderators is possible through communication with the site administration.
Privacy Agreement
5.1. The collection, use, and disclosure of information that may be considered confidential are carried out based on the Privacy Agreement (https://itc.ua/confidentiality_agreement/).
5.2. By accepting the terms of this agreement or visiting the site’s pages, the visitor automatically agrees to the terms of the Privacy Agreement regarding the use of personalized and non-personalized confidential information accordingly.
5.3. The collection, storage, use, processing, and disclosure of information obtained by the site administration as a result of a private person’s (visitor or user) visits to its sites and/or completion of registration forms, including user personal data, are carried out by the site administration in accordance with Ukrainian legislation. A private individual (visitor or user) realizes and agrees to the collection and processing of their personal data by the site administration within the framework and for the purposes specified in the User Agreement and Privacy Agreement in accordance with Ukrainian legislation. The private individual is obliged to inform the site administration in writing of any changes to their personal data.
Final Provisions
6.1. By filling out the registration form on the site, the visitor automatically accepts the terms of this Agreement.
6.2. The visitor accepts the terms of the Agreement by actual use of the site. In this case, the user understands and agrees that the site administration will consider the user’s use of the site as consent to the terms of the Agreement from the respective moment.
6.3. The site administration’s activities are carried out in accordance with Ukrainian legislation. Any claims, disputes, official appeals will be considered exclusively in accordance with Ukrainian legislation.
6.4. The site administration is not responsible for any direct or indirect damages caused by visitors, users, or third parties, as well as for any lost benefits resulting from ITC.ua activities.
6.5. The user agrees that they bear sole responsibility (and the site administration is not responsible to the user or any third parties) for any violation of the user’s obligations established by this Agreement and for all consequences of such violations (including any damages or losses that may be incurred by the site administration).
6.6. The terms of this Agreement may be changed by the site administration unilaterally. The current Agreement text is available at https://itc.ua/en/user-agreement/.
