Although Apple and its products are called «apple» in Ukraine (because of the «in»), this is not officially the case. The IPR Appeals Chamber refused companies in the rights to the brand «Yabloko».
The spelling of the word in Russian has nothing to do with it. The national intellectual property authority refused to grant Apple as early as 2021 — the trademark was already registered in 2006 by LLC «Krymfrukt» and later in the name of a private individual.
In the same year, Apple filed an appeal. The company believes that the trademark «Apple» and the logo in the form of an apple and the word «Яблоко» evoke strong associations with its products and services, and therefore, of course, should belong to it. The fact that this is a commonly used name for a fruit and is associated with it has never upset Apple.
In the appeal, Apple emphasized that neither LLC «Krymfrukt» nor the private owner was engaged in business activities, so there would be no brand confusion. The Appeals Chamber analyzed the circumstances and concluded that there were no grounds to uphold the appeal.
This is not the first time Apple has aggressively forced companies, including those with a much longer history than its own, to stop using the apple logo or names. Sometimes this goes beyond common sense, as in the case of an incentive to give up the pear in the logo.
