Fines of the Transfer Pricing Commission: Courts have considered more than 300 cases and in most cases side with plaintiffs

Between June and October 2024, Ukrainian courts considered at least 314 cases of appealing against fines from the Transfer Pricing Commission. These are decisions made after the introduction of the new military registration rules and fines for their violation.

It is noted that the number of such cases is constantly growing – more and more of them every month. If in June there were only 10 cases of canceling fines of the MCC, in September the number of appeals reached 148. Since the beginning of October (in fact, for a third of the month), 34 cases have already been considered.

It turned out that in most cases, the courts sided with the plaintiffs and canceled the TP fines. Currently, there are three main reasons for the cancellation of fines:

  • failure of the TCC to follow the procedure for imposing a fine.
  • lack of convincing evidence of violations by citizens.
  • fines are imposed for the period when the new rules have not yet entered into force, which is the basis for their cancellation.

At the same time, since the beginning of the year, the Enforcement Service as a whole more than 12 thousand fines for violations of military registration were transferred from the TCC.
