The National Security Committee recommends that the Verkhovna Rada of Ukraine approve draft law No. 12066. This document provides for permission to access the medical information of conscripts, persons liable for military service and reservists, as well as its inclusion in the «Oberig» register.
In fact, a special exception will be added to Article 24-3 of the Law «Fundamentals of the Legislation of Ukraine on Healthcare», which provides that access to medical information about a patient is not allowed during information interaction. As a result, access to medical information about a patient during information interaction will be allowed for the purpose of obtaining information by the Ministry of Defense of Ukraine on the results of medical examinations of conscripts, persons liable for military service and reservists conducted to determine their fitness for military service for inclusion in the Unified State Register of Conscripts, Persons Liable for Military Service and Reservists «Oberig» for the purpose of ensuring national security and defense.
Thus, the electronic healthcare system (EHRS) will start automatically «sharing» data with the Unified State Register of Conscripts, Persons Liable for Military Service and Reservists «Oberih». The co-author of the draft law, Oleksandr Fediyenko, explained that little will change for those liable for military service, as the information after the preliminary medical examination is already entered into the «Oberih» system.
According to the co-author of the draft law No. 12066, the proposed rule only clarifies that the data on the conclusion will be transferred from the EHR system to the «Oberig» system immediately, not within a day.
He also added that currently «Article 32 of the Constitution establishes derogations for processing confidential information about a person without consent – on the basis of law for national security purposes».
Earlier, Deputy Minister of Defense for Digitalization Kateryna Chernogorenko noted that the Ministry of Defense has already prepared draft amendments to the legislation as part of the digitalization of the MEC, which will allow the transfer of information about the health status of a person liable for military service from a civilian medical institution to the systems of the Ministry of Defense in a matter of minutes. That is, not only from the MEC, but also from ordinary private hospitals.
