The NCCEC fined «Kyivstar» UAH 51 thousand ─ the subscriber’s money was sent to a bonus account

The National Commission for the State Regulation of Electronic Communications, Radio Frequency Spectrum and Postal Services (NCCS), imposed a fine per company «Kyivstar» in the amount of UAH 51 thousand. Reason — violation of consumer rights when changing the form of service. The company transferred money from the main account to the bonus account without the subscriber’s consent.

According to the NCCC, the incident occurred when the user switched from a prepaid service to a contract service. The company transferred the balance from the personal account to the bonus account, although it did not receive any consent from the subscriber. The reason for the unscheduled inspection was a complaint from the user Shevelenko I.V. Based on its results, the Commission decided to bring the operator to justice.

The regulator reminded that mobile operators do not have the right to transfer funds from the main account to bonuses or points without the subscriber’s consent — regardless of whether the form of service is changed, the contract is terminated, or the number is ported to another operator. Bonus credits are non-refundable, as companies provide them as part of promotions. Therefore, it is unacceptable to save real money of subscribers in this way.

The decision to impose a fine is based on the violation of part two of Article 104 of the Law of Ukraine «On Electronic Communications» and subparagraph 5 of paragraph 64 of the Rules for Provision and Receipt of Telecommunication Services. «Kyivstar» has 30 days to pay the fine from the date of receipt of a copy of the decision.

The NCCIR urged subscribers to closely monitor their rights and not to delay contacting the regulator if the operator does not respond to their requests. The Commission emphasized that it is committed to protecting the legitimate interests of telecommunications users.

The decision on the fine was signed by the Chairman of the NCCC Oleksandr Zhyvotovsky. The full text of the resolution is available at the regulator’s website.
