
Recently Apple is criticized for slow progress in everything related to artificial intelligence and Siri. The company postponed the release of Siri with improved Apple Intelligence and in general may switch to the competing Google Gemini AI model.
None of this is encouraging to iPhone buyers who expected advanced AI features in their smartphones, but are still limited to promises and beautiful rendered videos. As a result, Apple has found itself at the center of a lawsuit in federal court over allegations of false advertising of a number of Apple Intelligence features.
The lawsuit, filed in the U.S. District Court in San Jose, claims class action status and seeks compensation for purchasers of iPhones and other devices that support Apple Intelligence. The plaintiffs claim that the owners of these gadgets did not receive the promised features.
«Apple’s advertising created clear and reasonable consumer expectations that these revolutionary features would be available immediately upon the release of the iPhone,» the plaintiffs’ lawyers said in their complaint. «However, contrary to Apple’s claims of advanced AI capabilities, the products contain a significantly limited or non-existent version of Apple Intelligence, which misleads consumers about their actual functionality and performance».
While it is true that Apple has not yet realized the promised AI features, the prospects for this lawsuit are rather dim. The problem with the lawsuit is that every commercial, video, poster, website, or mention of these unreleased AI features contained the disclaimer «coming soon». Even the advertisements themselves contain a disclaimer that cannot be overlooked, which says «some features and languages will be coming within the next year».
One could argue that this is still within the «next year» range. It is difficult to say whether the San Jose court will take up this lawsuit or elevate it to class action status, especially since the damage caused is difficult to measure.
In any case, this lawsuit has become another problem for Apple, which is trying to implement the long-awaited Apple Intelligence features. Recently, Bloomberg reported that Apple CEO Tim Cook «lost confidence in the ability of AI head John Gianandrea to effectively implement product development».
