The government plans to collect taxes on every sale through OLX, Rozetka, and Prom — draft law

Recently, there have been reports that the tax authorities are going to monitor people’s online sales and fine those who do not pay taxes on such income. Subsequently, the tax authorities have issued a refutation and said that they would only control entrepreneurs who systematically sell goods through online platforms and may evade taxes. But ordinary citizens who sometimes sell their belongings online have nothing to worry about. However, it seems that ordinary Ukrainians should not relax.

The Ministry of Finance has prepared a draft law that provides for new rules for taxing income received by individuals through digital trading platforms. We are talking about such platforms as OLX, Prom, Rozetka, etc. About this reports People’s Deputy of Ukraine Nina Yuzhanina.

According to the document, digital platforms will be obliged to annually provide the Tax Service with information on all registered sellers who have made at least one sale transaction during the year. In addition, such platforms will have to acquire the status of tax agents and withhold personal income tax (PIT) and military duty from the sellers’ income. Currently, the personal income tax rate is 18% and the military duty is 5%. Thus, when selling used goods, sellers will automatically be charged 23% of the proceeds, or UAH 230 for every UAH 1,000.

The Ministry of Finance refers to the practice of the European Union and the implementation of the provisions of Council Directive (EU) 2021/514 of March 22, 2021 (DAC7), which concerns the tax transparency of digital platforms. However, according to experts, the draft law does not take into account the thresholds established in the EU for the transfer of tax data.

In EU countries, data is transferred to tax authorities only if the seller’s income exceeds €2,000 per year or at least 30 sales have been made. The version proposed by the Ministry of Finance does not provide for such restrictions — reporting will apply to all sellers, regardless of sales volumes. Even if you sell one item in a year and receive UAH 1 of income for it.

It is expected that more details on the draft law will be made public after its official registration in the Verkhovna Rada.

At the same time, the governmentplans to increase taxes for individual entrepreneurs to 17% and complicate «simplify».
