The TCC fined a man UAH 17 thousand because of the absence of a paper PIR and a QR code in «Reserve+» ─ What did the court decide?

Some of the Ukrainians liable for military service avoid updating the «Reserve+» app to prevent the QR code from appearing in it. However, this can be a reason for imposing a fine by the MCC. One of the men tested this on himself. Later, he tried to cancel the fine in court, but it didn’t go as planned.

So, in August 2024, the man underwent a pre-employment testing at the city MCC. He states that after the medical examination, he handed over his paper military registration document (MRD) to the MCC so that they could put the necessary marks on the VLC. Instead of the paper military registration document issued on 10.05.2000, he was not given any temporary document or other confirmation. However, he was assured that all the information was duplicated in the «Reserve+» application, and this was sufficient to confirm military registration documents during inspections.

Already on September 16, 2024, this man was stopped by TCC employees to check his military registration documents. Since the original military ticket was in the TCC, the man showed an electronic document on his phone in «Reserve+», but it was not recognized as valid due to the absence of a QR code. Despite explanations that he would receive the ticket back on September 20, when it was his turn, he was forcibly taken to the TCC.

On September 23, the head of the TCC issued a resolution to impose a fine of UAH 17 thousand on this person liable for military service for violating the rules of military registration (under Part 3 of Article 210-1 of the Code of Administrative Offenses). However, the man disagreed with this and in October filed a lawsuit to cancel the decision.

The plaintiff explained that his electronic document in the «Reserve+» application did not have a QR code at the time of the inspection, as he had updated the application only in November 2024. The court found that without a QR code, a military registration document cannot be used for verification.

The court referred to the Cabinet of Ministers’ Resolution No. 559 of May 16, 2024, according to which an electronic military registration document is formed after identification of a person and must contain a QR code. This code allows technical means to read data confirming the identity of the holder. Without it, the document is not valid, even if it contains the correct information.

The man was unable to provide written evidence that his military ID card was actually in the TCC and that he had been warned about the possibility of using the digital version. The court emphasized that the absence of a QR code makes an electronic document invalid, and therefore the fine was lawfully imposed.

The court found the claim unfounded and upheld the TCC’s decision. This means that the fine of UAH 17 thousand remains in force, and the use of electronic military registration documents without a QR code may result in similar sanctions in the future.
