Ukraine will officially ban «unwanted calls» and oblige operators to disclose the data of those who make them — details of the bill

On Wednesday, the Verkhovna Rada approved as a basis the draft law 8153 «On Personal Data Protection», which, among other things, provides for new articles on «tracking and prohibiting malicious or unwanted calls to mobile subscribers».

According to the text of the document, which was reviewed by Judicial and legal newspaper it is proposed to enshrine in law «the prohibition of making unwanted calls or sending messages» and to enable the subscriber to submit a written request to the operator to track them or establish the contact details of the person or company that makes/sends them.

Request for contact information must be submitted in writing and contain information confirming that the subscriber receives unwanted calls from the number mentioned in the application, as well as a written commitment to use the data provided by the operator solely for the purpose of protecting their interests in court. The provider of electronic communication networks or services is obliged to respond within 10 days — satisfy or deny the request (in cases where the subscriber did not provide the necessary data in the application).

In case of a positive response, it will contain information about the number of the terminal equipment and the name of the subscriber making unwanted calls or sending messages, as well as (if available) the address of the place of residence or the address of registration of the legal entity.

Additionally, the operator must notify the subscriber whose data was shared of the request within three business days of the responseIf the operator receives a statement on tracking malicious or unwanted calls. The service provider must temporarily (but not more than 3 months) record the origin of all calls to the subscriber’s terminal equipment or network endpoints, including those for which there is a requirement for non-identification. The service provider must also retain the tracking data and provide it to the subscriber in writing.
