Five years for TikTok video of TCC and confiscation of iPhone — how Odesa resident escaped prison

A resident of Odesa was sentenced to five years in prison because of a video of the TCC’s actions on TikTok. However, the sentence was commuted to a lighter one.

The previously unconvicted driver of an Odesa utility company filmed actions of TCC members and the police to mobilize on his smartphone and posted the video on the TikTok platform. According to the verdict, «’s post was viewed by a significant number of people who liked it, 557 commented on it, and 541 saved it.

Obviously, the now former iPhone 11 owner liked the popularity and repeated the offense again. However, this time there were ten times fewer comments. The court notes that the video makes it possible to identify the military on the ground. The verdict recalls that such actions are a criminal offense Part 1 of Article 114-1 of the Criminal Code of Ukraine:

«During the special period, the disclosure of information about mobilization activities that were not published in the public information space and on official pages … may interfere with the legitimate activities of the Armed Forces of Ukraine and other military formations».

However, the offender pleaded guilty and entered into a plea agreement with the investigation. According to it, 5 years in prison were replaced by a probationary period of 1 year. The convicted person must periodically report for registration, notify of changes in his place of residence, work, or study, and not leave Ukraine without the consent of the probation authority.
